Types of Wills in California

Wills in California are basically of two types:

1) Witnessed. A witnessed will requires the formalities specified in the California Probate Code requiring that the will must be in writing, signed in one of the ways provided in the Probate Code, and witnessed by at least two persons each of whom is present at the same time and witnessed either the signing of the will or testator’s acknowledgment of the signature of the will, and understand that the instrument they signed is the testator’s will.

2) Holographic. The second type is a holographic will, which does not require formalities, but the signature and material provisions must be in the handwriting of the testator.
